Language |
• FILMAKA will have final and binding decision as to what is deemed ‘acceptable content’. Films with the following content will not be accepted: Pornographic, exceedingly vulgar, exceedingly offensive/obscene and/or third party copyrighted material.
• One minute minimum to three minutes maximum length for the periodic contests and
between 30 seconds - Three Minutes for Filmaka Journal.
• All submissions must conform to the guidelines of the contest for which they are submitted and to the terms and conditions
• Submissions to conform to delivery rules |

• The filmaka.in contest will accept submissions in all South Asian languages including english.
Payment
• Upload credits for the Periodic contests can be purchased using all major credit cards through the FILMAKA website. There are no charges to upload to the Filmaka Journal. |

Rules for redeeming the points :
a. If one member has uploaded films from different usernames, then he/she cannot club the points of the different usernames to claim prizes. Each username is treated as a separate and unique member.
b. Transfer of points to another account is not allowed.
c. Disqualification of a film, leads to withdrawal of the points assigned for the specific film. d. Points assigned for winning an entry level or jury level film will be added only when the delivery guidelines have been fulfilled.
e. If a film has a team under the directorial credits, any member of the team redeeming the points shall be considered to possess the right to act on behalf of the others.
f. Points once redeemed, cannot be reclaimed.
g. Delivery of prizes, would take an estimated 20 working days, from the day after the order has been placed. i. The company shall not be responsible, for the loss or destruction of the prize, while it is in transit. |

Uploading Technology |
Raw uncompressed video is a large file size and cannot be posted. It must be compressed prior to uploading. Most capture software will include compression software that allows you different encoding choices.
Editing of your footage can be done using a number of free and premium software available widely.

Member terms and conditions
PLEASE READ THESE terms and conditions CAREFULLY.
1. Definitions. Capitalized words used herein have the following meanings:
a. “Acceptance” means the Company’s acceptance of a Short meeting the requirements of Paragraph
5.
b. “Contests” means contests run by the Company pursuant to Paragraph
8 & 9.
c. "Member" means a person that accepts the terms and conditions hereof by clicking “I Accept Membership” below.
d. “Company” means CCL Filmaka Pvt. Ltd. .
e. “Contests” means
1. Periodic Contests and Annual Contest
2. Filmaka Journal
f. “Jury” means a panel of three appointed by the
Company for each Contest from a pool of up to fifteen
industry professionals selected by the Company from time to time.
g. “Delivery Guidelines” means the Delivery Guidelines for Shorts that are submitted for the final round of the Periodic Contests or for the Final Contest, which guidelines are available on the Company’s website.
h. “Exclusive Rights” has the meaning set forth in
Paragraph 13(b).
i. “Periodic Contests” means contests run and announced by the Company periodically for Shorts based on a particular theme designated by the Company.
j. "Filmaka Journal" means Shorts submitted by members for the periodic competition run by the company
k. “Premium Shorts” means Shorts that are (i)
semi-finalists for any Periodic Contests and Shorts
submitted for the final round of such Contests, (ii)
special jury prize winners ,runners-up or winners of any
Periodic Contests, (iii) runners-up or winners of Final Contests, or (ii) acquired by the Company pursuant to Paragraph 13(c).
l. “Rights” has the meaning set forth in Paragraph 13.
m. “Shorts” means the short films
1. Between one minute and three minutes in length for
the Periodic Contests and Annual Contests
2. Between 30 seconds and Three Minutes in length for the Filmaka Journal
n.. "Points” refers to a numeric value assigned to certain activities in the “Point System”, stated in paragraph 10. These points can be redeemed from “The Stash”.
o. “The Stash” refers to a collection of prizes as per paragraph 11.
p. “Terms and conditions” means these Member terms and conditions.
2. Payment. Each Member agrees to pay the Company the submission fee per submission as per paragraph 3 (a) online via Visa, Diners Club, American
Express credit cards, Citibank E-cards and JCB cards on
our website. We also accept ITZ Cash Cards. Mobile phone
users can pay using PayMate. Pay Orders to be made in
the name of CCL Filmaka Pvt. Ltd and can be mailed to
CCL Filmaka Pvt. Ltd, 601, Landmark Bldg. Pali Naka,
Bandra (W), Mumbai 400 050. We do not accept cash.
3. Members. Each Member shall have the following rights and privileges with respect to the Company
a. To submit an unlimited number of Shorts for each Periodic Contest for a submission fee of INR 500 per Short.
b. To view and vote on the Shorts to win each Periodic pursuant to Paragraph 4; and
c. To build, view and submit , Shorts, pictures and audio clips for their journal, without any submission fee.
4. Voting Requirements. In order to cast a valid vote for any Periodic Contest, Members who have never submitted a Short to any Periodic Contest or have submitted at least one Short to any of the past contests are permitted to cast one vote equivalent to one rating for the best Short. Members who have submitted a Short in a current Periodic contest must cast a valid vote for that Contest as follows (a) vote on five Shorts and (b) rank them from 1-5, with 5 being the best. You cannot vote for Shorts you have submitted and cast one valid vote for five films regardless of the number of shorts you have submitted.
5. Submission Requirements In order to validly submit a Short for any Contest, it must meet all of the following conditions for Acceptance, as determined by the Company in its sole and absolute discretion:
For the Periodic Contest :
a. The Short must be based on the theme designated by the Company for that Contest;
b. The Short must not contain any content that would be rated more restrictively than “A“;
c. You must submit your correct email address;
d. For Shorts submitted for the Periodic Contests, you must cast a valid vote for that Contest in accordance with Paragraph 4. You can cast one valid vote for five films regardless of the number of shorts you have submitted in the contest.
f. Must pay the appropriate fee under Paragraph 3(a).
For the Filmaka Journal:
a. The short must be uploaded in the time frame provided by the company.
b. The Short must not contain any content that would be rated more restrictively than “A“
c. The duration of the short must be between 30 seconds
and Three Minutes in length.
6. Consequence of Invalid Submission. If anyone attempts an invalid submission of a Short for any reason, the Company will have the right, in its sole discretion, to implement one or more of any of the following sanctions:
a. Forfeiture of the submission fee or prize money for that submission.
b. Rejection or rescission of Acceptance and of the Short’s status as a semi-finalist, runner-up, special Jury prize winner or winner of any Contest (in which case the remaining Shorts shall move up one place); or
c. Termination of the Applicable Member’s status as a Member for repeated or egregious offenses.
7. Periodic Contests. The Company shall hold each Periodic Contest as long as a minimum of 25 films are submitted in a monthly competition. For each Periodic Contest, Members may submit any number of Shorts pursuant to Paragraph 5 based on the theme announced by the Company. All members who have uploaded a film for a specific months contest will vote to elect 3 semi-finalist Shorts for the specific Contest, and the Company may choose up to 3 additional semi-finalists. Additionally, the film that has the highest number of popular votes will also proceed to the next round. The Company shall pay INR 20,000 plus Re. 1 per view
in the corresponding month of the contest, up to a maximum of Rs 10,000. (which means a member can win a maximum prize money of Rs. 30,000 for each semi-finalist Short), who may then compete in a final round by submitting a new Short for that Periodic Contest for every Short they submitted that was a semi-finalist for that Periodic Contests. The Company shall pay each Applicable Member INR 30,000 upon Acceptance of each such new Short. The Jury will choose a 1st place winner (prize: INR 75,000),a runner-up (prize: INR 50,000), and one special Jury prize winner (no cash prize) from the semi-finalists.
Entrants, Winners at Entry Level and Jury Level to Periodic Contest will also receive Points as per the Point System
8. Annual Contest. At the end of the contest cycle, inclusive of Wild card Entry round, the winners, the runners-up, and the special Jury prize winner of the Periodic Contests and the Wild Card Entry round will compete in the Final Contest conducted. The eventual winner shall be given the opportunity to direct a feature film for the Company on terms and conditions determined by the Company, and Company shall pay the runner-up INR 11,00,000.
Note: There will be a “Wild Card” competition where one filmmaker will be selected by member voting, one by Filmaka and one by Jury (Selected by One or two Jury members from our Jury pool). These three winners will be allowed to compete in the Annual Competition.
9. Filmaka Journal: For the Filmaka Journal competition, Members may submit any number of Shorts, pursuant to Paragraph 5. These films will be viewed and voted by the members. From the top 10 vote getters, Filmaka will select will select a fortnightly winner, a runner up and a second runner up, these winners will receive Points as per Point System per paragraph 10(b)
10. Points system : For its contests, the company shall issue points as stated below , the company has the right to change the following structure at its discretion without giving any prior notice. These points can be redeemed from “The Stash” as per paragraph
11.
a. The Periodic Contests:

11.The stash : “The Stash” refers to a collection of prizes, that will be made available to the members for redemption against their Points. The company holds the rights of removing any item from the list as per its discretion, without giving any notice. Each prize has a particular number of points assigned to it. These can be redeemed by the member, depending on the points earned by them as per paragraph 10 . The prizes with their corresponding points are as follows :
Mobile phones: 30 points
Digital cameras: 90 points
Camcorders: 150 Points
Mini DV cameras: 210 points
HDV cameras: 270 points
Laptops: 360 points
FCP software: 420 points
Full HD cameras: 600 points.
12. . Redemption of the points: The following rules will apply for all the contests, organized and executed by the company:

13. Grant of Rights: By uploading a Short, you hereby grant to the Company the following rights (the "Rights"):
a. The right to permit such Short to be posted and viewed by third parties on the Company's website. This right will be exclusive for twelve months from the date of submission to the Company, and the Member will not permit the Short to be shown anywhere else during that time..
b. For Premium Shorts, the copyright to the Shorts and all underlying material thereto, including, without limitation, all rights protected under the Copyright Act and the exclusive, perpetual, worldwide right to exploit, sublicense, and assign the Short and all ancillary and derivative rights thereto in all media now known or hereafter devised in any and all languages (the "Exclusive Rights").
c. A twelve-month option (commencing from the date of submission to the Company) to elect to acquire the Exclusive Rights to such Short in consideration for the compensation payable under Paragraph 14, to be exercised by email notice to the Applicable Member. Upon exercise of such option, (i) the Exclusive Rights to such Short shall automatically be transferred to the Company and (ii) the Applicable Member must comply with the Delivery Guidelines for such Short.
14. Compensation. As full consideration for the grant of the Exclusive Rights, the Company will pay the Applicable Member a royalty equal to (a) 50% of “Gross Receipts” (defined below) from such Exclusive Rights minus (b) the sum of (i) all expenses paid by the Company relating to the acquisition, development, production, or distribution of such Exclusive Rights, (ii) interest at 6% on the amount of such expenses from the date incurred to the date of recoupment, and (iii) a distribution fee to the Company equal to 20% of Gross Receipts. “Gross Receipts” shall mean all nonrefundable cash revenues actually received by the Company attributable to the Exclusive Rights, except that (a) only 22% of all video/DVD/VOD or similar revenue received by the Company shall be included in Gross Receipts, and the manufacturing and shipping costs relating to such revenue shall not be deducted, and (b) all membership fees and Short submission fees shall be excluded. In the event that multiple Shorts are distributed as part of a compilation (e.g. we put 10 Shorts on a DVD and sell it to the public), the 22% royalty included in Gross Receipts shall be pro rated among the Applicable Members submitting such Shorts. All payments shall be made sixty days after the end of each calendar quarter (accompanied by an accounting statement setting forth the calculation thereof), unless the total revenues due to you are less than INR 25,000 in which case payments shall be made on an annual basis.
15. Your Representations and Warranties. You represent and warrant that you have the full right and authority to grant the Rights and that our exploitation of the Rights will not violate any rights of any persons.
16. Indemnity. You hereby indemnify and hold us harmless if we incur any loss, cost, or expense (including attorneys’ fees), due to any claim by you or any other parties relating to our exploitation of the Rights.
17. No Downloading or Copying. You agree not to download or copy any Shorts, and you will indemnify the Company for any loss, cost, or expense (including attorneys’ fees) if you breach this provision.
18. Notices. All notices shall be in writing and shall be delivered by e-mail to each party’s last known email address.
19. Modifications to the company's services. The company reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Filmaka journal (or any part thereof) with or without notice. You agree that the company shall not be liable to you or to any third party for any modification, suspension or discontinuance of the contest
20. The following is a partial list of the kind of Content that is illegal or prohibited to post on or through the contest. The company reserves the right to investigate and take appropriate legal action against anyone who, in the company’s sole discretion, violates this provision, including without limitation, removing the offending communication from the contest and terminating the membership of such violators. prohibited Content includes, but is not limited to Content that, in the sole discretion of the company:
a. is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
b. harasses or advocates harassment of another person;
c. exploits people in a sexual or violent manner;
d. contains nudity, violence, or offensive subject matter or contains a link to an adult website;
e. solicits personal information from anyone under 18;
f. provides any telephone numbers, street addresses, last names, URLs or email addresses;
g. promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
h. promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
i. involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spimming," or "spamming";
j. contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
k. furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
l. solicits passwords or personal identifying information for commercial or unlawful purposes from other Users;
m. involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;
n. includes a photograph of another person that you have posted without that person's consent; or
o. for user profiles, uses of sexually suggestive imagery or any other unfair, misleading or deceptive Content intended to draw traffic to the profile.
21. The company assumes no responsibility for actively monitoring the contest and comments for inappropriate Messages. If at any time the company chooses, in our sole discretion, to monitor the contest, the company nevertheless assumes no responsibility for the content of the Messages, no obligation to modify or remove any inappropriate Messages, and no responsibility for the conduct of the user submitting any Messages. In submitting Messages to the contest, you agree to strictly limit yourself to discussions about the subject matter of the contest. You agree that the company accepts no liability whatsoever if the company prevents your Messages from being submitted or if the company edits, restrict or remove your Messages. You also agree to permit any other user of this Site to access, view, store, or reproduce your Messages for that other user's personal use and not to restrict or inhibit the use of this Site by any other person.
22. Entire Agreement. These terms and conditions and the other items referred to herein represent the complete agreement of the parties relating to the subject matter hereof.
23. Amendment. The Company reserves the right to amend these terms and conditions at any time by posting notice thereof on its website.
24. Governing Law. These terms and conditions are governed by the laws of
India (i.e., without regard to its conflict of law
principles). The exclusive location for any litigation
relating to these terms and conditions shall be in
Mumbai, India.
25. Taxes. All applicable
taxes by the Indian Income Tax Department will be
deducted prior to issuing any prize money.
26. Disclaimer. It is possible that Shorts posted to our website may be downloaded or copied by third parties without our permission, and you waive any claim against us for such actions.
27. Further Actions. You agree to execute any and all documents and take any other actions reasonably required to effectuate the purposes of these terms and conditions.
28. Execution. By clicking the appropriate “I Accept” button below, you are “signing” these terms and conditions for all purposes under the Indian applicable law, including the United States Copyright Act and the Electronic Signatures and Global and National Commerce Acts.

Please make sure to keep the likely rating of your content equal to or less restrictive than “'A'”
rated.
Please make sure to have everybody who appears recognizably in your film execute a talent release form. You can download the appropriate talent release form from this website. Please make sure to use our standardized Filmaka, LLC talent release form in English for all of your actors and participants etc., no other forms will be accepted.
Please make sure that you use only self-composed and self-recorded music, or only fully licensed third party music. The music licenses must cover the publishing and the synch license. You can download the appropriate music release form from this website. Please make sure to use our standardized Filmaka, LLC music release form in English. No other forms will be accepted.
Please make sure to keep the master tape/DVD that contains your work professionally stored at all times. Upon receipt of your prize money, please make sure to deliver your master and any copies/dupes you have made of the master to
Filmaka.in at the below address.
